1 About Art N Artist
Art N Artist is a digital platform operated by Nav Shri Art & Culture Organisation. It provides digital E-Profiles and related tools for artists, creators, performers, institutes and other creative professionals.
Platform features may include public profiles, contact information, services, testimonials, galleries, videos, social links, profile themes, enquiries, profile and QR analytics, Profile QR Codes and Contact QR Codes.
2 Acceptance of Terms
By visiting the website or using an Art N Artist account, you confirm that you have read and accepted these Terms and Conditions.
If you do not agree with these terms, you should not register an account, submit profile information or use restricted platform features.
3 Eligibility
You must be legally capable of entering into an agreement under applicable law. If you are below the legal age for entering into a contract, your parent or legal guardian must review and accept these terms on your behalf.
A parent, guardian, institute or authorised representative creating or managing a profile for another person confirms that they have the necessary authority and permissions.
4 Account Registration and Security
When creating or managing an account, you agree to:
- Provide accurate, complete and current information.
- Keep your login credentials confidential.
- Use a strong password and update it when necessary.
- Not share, sell or transfer your account without permission.
- Notify us if you suspect unauthorised account access.
You are responsible for activity performed through your account unless you have promptly reported unauthorised use.
5 Artist E-Profile Services
You may use your account to create and manage a public E-Profile. Available features can depend on your selected plan, account status and current platform configuration.
You are responsible for reviewing your public profile and ensuring that its name, biography, contact details, links, images, services, gallery, videos and other information are accurate and suitable for publication.
Art N Artist does not guarantee that a profile will generate enquiries, employment, sales, commissions, recognition, followers or any particular business result.
6 Your Content and Permissions
You retain ownership of original content that you upload, including profile text, artwork images, photographs, videos, logos and other materials.
By uploading or submitting content, you give Art N Artist a non-exclusive, worldwide and royalty-free permission to store, process, resize, crop, display and technically reproduce that content only as necessary to operate, maintain, promote and improve your E-Profile and platform services.
You confirm that:
- You own the content or have permission to use it.
- Publication of the content does not violate copyright, trademark, privacy, publicity or other rights.
- You have permission from identifiable individuals appearing in uploaded photographs or videos where permission is legally required.
- Information and claims included in your profile are truthful and not misleading.
7 Prohibited Content and Conduct
You must not use Art N Artist to:
- Upload unlawful, fraudulent or misleading content.
- Infringe copyright, trademark, privacy or other third-party rights.
- Publish obscene, abusive, hateful, threatening or discriminatory material.
- Impersonate another person, artist, institute or organisation.
- Distribute malware, harmful code, spam or unauthorised advertising.
- Attempt to bypass security, access another account or disrupt the platform.
- Scrape, copy or commercially exploit platform data without written permission.
- Use the platform for activities prohibited by applicable law.
8 Public Visibility and Search
An active E-Profile is generally accessible through its public URL. Profile information selected for public display may be visible to website visitors and may also be indexed by external search engines.
The “Show my profile in homepage search” setting controls whether your profile appears in the Art N Artist homepage search. Turning this setting off does not automatically disable the direct public profile link.
Search engines operate independently. Removing a profile from Art N Artist search or changing its visibility may not immediately remove previously indexed results, cached pages or external references.
9 QR Codes and Analytics
Art N Artist may provide Profile QR Codes and Contact QR Codes for downloading, printing, copying or sharing.
Before distributing a QR code, you should verify that it opens the intended profile or contact information. You are responsible for selecting which contact details are included in your Contact Card.
Profile view and QR scan analytics are provided for general informational purposes. Counts may be affected by browser settings, network conditions, automated traffic, privacy tools, repeated visits or technical filtering and may not represent unique individuals.
Previously downloaded or printed QR codes may continue to contain information that was included when they were generated. Update or replace distributed material whenever your details change.
10 Enquiries and Visitor Communication
Visitors may contact profile owners through enquiry or contact features. Art N Artist provides the communication facility but is not a party to any later discussion, transaction, commission, employment arrangement or dispute between a visitor and profile owner.
Users should independently verify enquiries before sharing sensitive information, accepting payments, delivering work or entering into an agreement.
Deleting an enquiry from your dashboard permanently removes it from your account view. Keep any records required for your own business or legal purposes before deletion.
11 Plans, Fees and Payments
Some features may be offered through a free trial, free access period or paid plan. Applicable price, duration, included features and payment conditions should be shown or communicated before payment.
A free trial may expire automatically at the end of the stated trial period. Continued access to paid features may require payment or renewal.
Unless expressly stated during purchase, a plan should not be treated as automatically renewed. Any applicable taxes may be added as required by law.
Cancellation or refund eligibility will depend on the plan-specific terms communicated at the time of purchase and applicable consumer law. Nothing in these terms removes any statutory consumer right that cannot legally be excluded.
12 Third-Party Services and Links
Profiles and website pages may contain links or embedded content from YouTube, WhatsApp, social media platforms, personal websites, payment providers, analytics services, CAPTCHA services and other third parties.
Third-party services are governed by their own terms and privacy policies. Art N Artist does not control or endorse all external content and is not responsible for the availability, security or practices of third-party services.
13 Platform Intellectual Property
The Art N Artist name, branding, website design, interface, source code, platform graphics, original text and platform functionality are owned by or licensed to Art N Artist and Nav Shri Art & Culture Organisation.
These materials may not be copied, modified, redistributed, sold or commercially exploited without prior written permission, except where permitted by applicable law.
14 Suspension and Termination
We may review, restrict, hide, suspend or remove an account, profile or content where reasonably necessary because of:
- A violation of these terms or applicable law.
- Suspected fraud, impersonation or security risk.
- Copyright, privacy or other rights complaints.
- Non-payment or expiry of an applicable plan.
- Harm to users, the platform or third parties.
Where reasonably possible, we may provide notice or an opportunity to correct the issue, except where immediate action is necessary for security, legal or safety reasons.
15 Service Availability
We aim to keep the platform available and secure, but do not guarantee uninterrupted or error-free operation. Services may be temporarily unavailable because of maintenance, updates, hosting issues, internet failures, security incidents or circumstances outside our control.
Features, layouts and technical requirements may be updated to improve security, usability or platform performance.
16 Disclaimers and Limitation of Liability
The platform is provided on an “as available” basis. Users remain responsible for their content, communications, professional claims and transactions.
To the maximum extent permitted by applicable law, Art N Artist and Nav Shri Art & Culture Organisation will not be responsible for indirect or consequential loss arising from third-party conduct, external links, user-generated content, unauthorised account access or temporary service interruption.
Nothing in these terms limits liability or consumer rights that cannot legally be limited or excluded.
17 Privacy and Data
Personal information is handled according to our Privacy Policy.
Users should not publish sensitive personal information that is unnecessary for their public profile. Carefully review contact visibility and Contact Card selections before saving or sharing them.
18 Changes to These Terms
We may update these Terms and Conditions when platform features, business practices or legal requirements change. The revised version will be published on this page with an updated revision date.
Continued use after an updated version becomes effective constitutes acceptance of the revised terms, to the extent permitted by applicable law.
19 Governing Law
These Terms and Conditions are governed by the laws of India. Subject to applicable consumer rights and mandatory legal provisions, disputes will be submitted to the courts of competent jurisdiction in Delhi, India.
